Services

Hotel bookings, flight reservations, and travel services are available through us. The type of service provided depends on the facility and the availability. The Services are subject to modification, change, or discontinuation at any time. When the Service is terminated or expires, access to the Site is terminated.

Termination

Under certain circumstances (non-exclusive list) we may terminate the Service:

• If you violate any terms or conditions
• In the event that services are abused or misused.
• Suspension of an account or service may be temporary if a large number of cost-effective services are exploited, such as SMS and Whatsapp.
• Using the platform for spamming of any kind
• You use the Service in a way that disrupts our business or affects third parties
• You can terminate your account at any time by emailing our Customer Service team.

Restrictions

• Develop similar products by reverse engineering, decompiling code, and decomposing software.
• Copies, edits, alterations or translations of the software/app
• Any commercial use of software reselling.
• To provide any other parties with commercial services.

Agreeing to Communicate Digitally

As you use the Site digitally, you agree that Yugo.pk may communicate with you digitally regarding all aspects of your use of the Site, including through e-mail. Use this Site only if you are comfortable conducting business digitally. E-mail notifications are not guaranteed. As long as the law doesn't prohibit it, you waive any laws that require different communication methods when using this site. In order to fulfill the request and book the Services, You warrant that You have all the necessary consents and authorizations from the data subject for the transfer of their personal data to Us as well as authorizing Us to proceed with all subsequent transfers of data.

As a result of any administrative sanctions imposed by the relevant authorities, along with damages or losses in any judicial or non-judicial proceedings brought against Us, we shall bear as applicable, the fees for Legal Counsel, Court Liaisons, or any other professional advice, which will be specifically considered for early termination of the provided services.

Representations & Warranties

The following is your representation and warranty:

• Having the legal right and ability to enter into and make the representations and warranties set forth in these Terms;
• We only accept true and accurate information from you
• You are in compliance with all applicable laws and have made relevant filings/ declarations and have obtained requisite approvals and registrations under applicable laws
• It is your responsibility to perform the Agreement's obligations in accordance with applicable law
• Your registration and account information will be kept up-to-date
• Even if such use was done without your authority or permission, you will be responsible for its use
• These Terms prohibit you from using the Site for any unlawful or prohibited purposes
• It is prohibited to display, communicate, publish, distribute, or share TBO's Rates or Inventory to any B2C channel directly or indirectly at any time. In this clause, "Inventory" means and includes all of Yugo.pk's products and services, as listed on its System. The "Rates" refer to the individual pricing of each Inventory item, as specified in the System. Consumer-to-consumer channels are available directly to end users (travelers) via an online platform.

For any breach of the above Agreement, you shall be held liable for the following.

• Penalty of $ 5,000 for each instance, due upon demand
• Further, Yugo.pk reserves the right to temporarily suspend or terminate the Agreement if it is breached.

Your Responsibility

When you apply for our services, you will receive an Agent ID and be asked to select a password. Your Agent ID and password are the means by which you access certain services (Account). You acknowledge and agree that it is your responsibility to keep the Agent ID and password safe from any unauthorized use. YUGO.pk is not responsible for unauthorized or wrongful use of your agent ID or password. We will hold on to any advance amount paid by you for a period of 360 days from when it was paid so that it can be used. Unused portions of such advances will be forfeited if they are not utilized within these 360 days. The amount must be claimed from Us within 360 days of the date of purchase. Yugo.pk is not obligated to process payment requests after that time period. It is the responsibility of the customer to maintain accurate account information, which includes their credit card information and contact details. Account settings can be used to update these details.

It is expected that the cancellation and replacement policies will be published on the website, as well as the expected timeframe for reporting an item/goods order to be cancelled or replaced. Accepted payment methods, card types and currency

We accept credit/debit card payments online using Visa and MasterCard in PKR (or any other agreed currency). For credit/debit card, additional charges may apply.

Delivery & Shipping Policy

f an order is placed, the process they will follow to deliver/ship the items/goods, the conditions and the time frame for them to reach their customers. We recommend that you state that https://www.yugo.pk/ will not deal with or provide any service or product to any OFAC sanctioned country in accordance with Pakistan law.

No Shows

The guest's failure to show up at the accommodation establishment without prior warning shall be considered a cancellation. No-shows will not be refunded.

Rates and currency

Any rate quoted is net and non-commissionable, inclusive of all taxes and service charges except for any taxes, resort fees or other charges payable directly by the guest at the hotel. The invoices must be paid in the same currency as when they were raised. If You wish to settle invoices in a different currency, we may allow it at our discretion, at an exchange rate we determine.

Booking Procedures for Hotels & Apartments

You cannot use the online booking system for any other kind of booking besides FITs. Bookings containing 9 or more rooms, either as a single booking or as consolidations, may also be considered as Group bookings by the Hotel, and may be cancelled if they violate the Hotel's booking policy. No Liability for Onward sales

We have a contract with you for the sale of travel components. Guest who purchase travel services contracts directly with You. You are responsible for selling travel services onward. Our company does not accept any liability for Onward Sales or for travel services which may go wrong. A classification of each accommodation is provided to us by the provider of the accommodation. Please note that we are not responsible or liable for any errata or incorrect information that the supplier provides to us, including but not limited to images, descriptions, amenities/facilities, tariffs, reviews, or any other information the supplier uses to market and promote its properties. Any dispute between You and a guest arising from the Onward Sale of a travel service by You to a guest is not our responsibility. You will indemnify Us from and against all losses, fees, expenses, and costs arising from any claim made against us following an Onward Sale by You.

Credit Card Chargeback

For bookings, you may use your company's credit cards or the credit cards of your guests. You may only use a guest's credit card to make reservations for the same guest. Bookings must be paid for with a genuine credit card, and you are responsible for this. If you use a fake or stolen credit card, or if you submit a chargeback, then you accept full responsibility.

Refunds

Refunds shall be made to the original instrument used at the time of booking. The amount will be stored as future available credit for the customer if YUGO.pk is unable to refund the amount immediately. Only the original method of payment will be refunded

Declarations

You and your clients, stake holders, and directors warrant that they are not on the list of the Office of Foreign Assets Control (OFAC), Specially Designated Nationals (SDN), or Blocked Persons. Any shareholder, director, or client whose name appears on any of the above lists must immediately notify us in writing.

Prohibited Conduct

Use of the Service must comply with the terms set forth herein and the laws of your country at all times.

This is a non-exhaustive list of prohibited content and behavior:

• Nudity, pornography, adult content, sex and foul language are all prohibited.
• Content that supports, promotes, contains, or links to hackers or other piracy-related information.
• The content that has been promoted by sending Spam or mail fraud schemes, or sites that promote or condone sending Spam.
• A bigoted, prejudiced, racist, sexist, anti-religious, or otherwise offensive statement, or any obscene, filthy, excessively violent, harassing, or otherwise objectionable material.
• Content that violates any copyright, patent, trademark, service mark, trade name, trade secret, or other intellectual property right of a third party.
• Contains materials that promote mail fraud, pyramid schemes or other illegal or fraudulent activities.
• Posting or revealing any information that identifies a third party without their express consent.
• Deriving the underlying source code, structure, or sequence of any technology, service, or solution by reverse engineering, reverse compiling, or otherwise.

By accepting these Terms, you agree to indemnify and hold YUGO.pk, its affiliates, sponsors, partners, directors, officers and employees harmless from and against, and to compensate YUGO.pk with respect to, any and all losses, damages, liabilities, claims, judgments, settlements, fines, legal fees, costs of investigation, and other expenses arising from or related to your breach of these Terms or your use of the Services by any third party.

Force Majeure

Any delay or failure in performance of these Terms that is caused by an event or circumstance that the party affected is unable to control and avoid, including, for instance, acts of God, government regulations, curtailment of transportation facilities, strikes and lockouts or other industrial actions or trade disputes of any nature (whether involving employees of the party or others), terrorist attacks, haze, sabotage, riots, civil disturbances, insurrections, national emergencies (whether in fact or law), blockades, acts of war, (declared or not), etc. (a "Force Majeure Event"). Non-performing party shall give the other party written notice of the Force Majeure Event as soon as possible.

Any variation in the payment terms will be treated as final under the invoice billing cycle and payment due date.

Independent Contractor

YUGO.pk and its customer are independent contractors. Between the parties, there is no partnership, joint venture, employment or franchise relationship. The parties cannot bind one another or incur obligations on the other's behalf without their prior written consent.

Dispute Resolution

If there is a dispute between you and us arising from or related to your use or attempted use of this Site and the Service, the dispute shall be submitted to arbitration. Each Party shall mutually appoint a sole arbitrator. The Parties will mutually appoint a sole arbitrator. Arbitration shall take place in Pakistan. The said arbitration proceedings shall be conducted according to the rules and regulations set forth by DIFC-LCIA Arbitration Centre.

Governing Body

Any dispute under these terms and conditions shall be exclusively subject to the jurisdiction of the Pakistan courts.
